DMCA Policy

Yorus respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act ("DMCA"). If you believe that content on Yorus infringes your copyright, you may submit a copyright notice as described below.

1. Filing a DMCA Takedown Notice

A DMCA takedown notice must be a written communication that includes substantially the information required by 17 U.S.C. 512(c)(3):

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
  2. Identification of the copyrighted work claimed to have been infringed;
  3. Identification of the material that is claimed to be infringing, with enough detail to locate it on Yorus, such as the bot URL, profile URL, message context, or image URL;
  4. Your contact information (name, address, telephone number, and email address);

3. Counter-Notification

If your content was removed because of a DMCA notice and you believe the removal was caused by mistake or misidentification, you may file a written counter-notification that includes substantially the information required by 17 U.S.C. 512(g)(3):

  1. Your physical or electronic signature;
  2. Identification of the material that was removed and the location where it appeared before removal;
  3. A statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification;
  4. Your name, address, and telephone number;
  5. A statement that you consent to the jurisdiction of the federal district court for the judicial district where your address is located, or, if your address is outside the United States, for any judicial district where Yorus may be found, and that you will accept service of process from the person who filed the original notice or that person's agent.

If we receive an effective counter-notification, we may forward it to the original complainant. Under the DMCA process, the removed material may be restored after 10 to 14 business days unless the complainant tells us that they have filed a court action seeking to restrain the allegedly infringing activity.

4. Repeat Infringers

Yorus will terminate the accounts of users who are determined to be repeat infringers in appropriate circumstances.

5. Good Faith

Please note that under Section 512(f) of the DMCA, any person who knowingly makes material misrepresentations in a takedown notice or counter-notification may be liable for damages. Do not file a DMCA notice unless you genuinely believe your copyright has been infringed.
